TERMS OF USE
PREAMBLE
Whereas, Doggity is an app and website owned and governed by Doggity LLC; and
Whereas, Doggity is offering its services in the USA as a platform for dog owners who are
looking to avail the service of dog sitters or dog walkers; and
Whereas, these Terms of Use have been drafted to provide information regarding rules,
regulations, and conditions set by Doggity for their website and app and to provide the
information through which users can avail of its services; and
Whereas, throughout the Terms of Use, Privacy Policy, and Disclaimer the terms such as “we”,
“our”, and “us” as well as Doggity has been used to describe Doggity’s website, company
and services therein.
Therefore, after availing, using, or visiting the website of Doggity the users, customers, clients
and visitors will be assumed to be in consent to these Terms of Service as well as our Privacy
Policy.
1. TERMS OF SERVICE OF THE DOGGITY
The following Terms of Service (“Terms”, “Terms of Use”, “Terms of Service”, and Doggity”) govern all
use of our services, mobile application (“app”) and website (collectively called “services” and “website”)
called Doggity. These Terms, as well as our Privacy Policy, posted on Doggity’s website, shall also be
equally applicable and enforced to the offers, services and projects of our website. These terms are
primarily directed towards all the users, dog owners and dog sitters (“you”, “your”, “user”) as well as
any visitors of Doggity’s website.
2. USER AGREEMENT
Together with our Privacy Policy, these Terms constitute an Agreement between Doggity and you as a
user. By visiting our website, you have engaged in ourService” and agree to be bound by the following
Terms and hence you are also in consent with this User Agreement. These services will also include the
terms and conditions or any other page where we have posted the link to these Terms. The following
Terms will apply to all the users who are using our website in any way and all the users hereby agree to
be bound by these Terms.
Make sure to properly read these Terms before starting to use our website. You agree to be bound by
these Terms by accessing our website. You do not have the authorization to use our website if you are
not agreeing with any of the Terms of Use, Privacy Policy, or any other specific agreement or policy
given through our website. If these Terms are considered an offer, acceptance is expressly limited to
these Terms.
3. DEFINITIONS & EXPLANATIONS
In our website's official documents:
a. “App” means the official mobile application of Doggity.

b. “CaLOPPA” means the California Online Privacy Protection Act which has been described in our
Privacy Policy.
c. “CCPA” is California Consumer Privacy Act.
d. “Cancellation” means the cancellation of the service between the owner and the sitter.
e. “Commission” means the amount in percentage charged from the sitters or service providers.
f. “Copyright” means any item of confidential information.
g. “Dog” has been used as a collective term for all pets. Mentioning dogs does not mean dogs
exclusively, rather it has been used for pets in general.
h. “Sitter” means the dog sitter who will offer his/her services for a fee to the owners on our
platform.
i. “Income” or “Earning means the earning of a sitter based on his/her rate which shall be paid by
the owner.
j. “Net Income” means the amount the sitter shall make after paying Doggity a 20% commission
from their income.
k. “Owner” or “Dog Owner” is the user who is going to hire the sitters for their services.
l. “Payment Methods” mean the methods under which the funds can be deposited on our
platform.
m. “Platformis the collective term for our app and website through which we will offer our
services.
n. “Price” means the total price of a job.
o. “Service” means the service attainable through our platform.
p. “User” means anyone who is registered on our website. This includes the sitters, owners,
independent workers or anyone registered on our app or website.
4. ACKNOWLEDGEMENT BY USERS
By accessing the Doggity website and using any of our services, you confirm that:
a. You are a mentally fit person who can form legal contracts.
b. You are at least 18 years old.
c. You are residing in the United States of America.
d. You are permitted under the laws applicable to you and any organization which you represent to
access our app and website.
e. You are not otherwise subject to any restriction prohibiting access to the Doggity website
imposed by the laws and regulations of your jurisdiction.
f. You will only use the services of Doggity for finding the job of taking care of the dogs/pets in
case you are a sitter.
g. You will only use the services of Doggity to hire a sitter for taking care of your own in case you
are the dog or pet owner.
h. You have never been convicted of a crime, complaint, or any other criminal suit.
i. You have never used drugs or you have been sober for at least 12 months.
4.1. Services Disclaimer
The information provided through our platform including all services is being provided ‘as is’ and is not
meant to be any professional or legally binding advice. In no way or case do we warrant or provide any
guarantee or representation as to the accuracy of the information provided through our app or website.

There may be content related to the different fields (including veterinary, medical, financial, or legal
fields) on our website by different users and services therein you as a user hereby agree and
acknowledge that you should consult relevant professionals before relying on any information on our
website and therefore, we will not be held responsible for any kind of liability.
5. PAYMENT AND CANCELLATION POLICY
Whenever you as a user use our services, it will be according to the rules and regulations. By using our
services, you hereby authorize us to allow the payment gateway to deduct the transaction amount from
your Stripe account in the future. The payment will be according to the job or payment plan. All the
payments will be made according to our payment policy and users can pay through the Stripe payment
platform. Please note that we reserve the right to change, remove or modify any of the payment
methods at our sole discretion without giving any prior notice.
5.2. Permission Of Recurring Payment
Through the use of Stripe, you as a customer hereby provide Doggity the authorization to charge you
the transaction amount by saving your credit or debit card on Stripe for future payments.
By authorizing us you hereby permit us that:
a. We can initiate a payment on your behalf.
b. These payments can be one-time or recurring.
c. We have the authority to determine the price based on services (specifically if there are
disputes).
6. PAYMENT POLICY TOWARDS SERVICE PROVIDERS
This payment policy is specifically directed towards the dog sitters and dog owners of Doggity. Your use
of our services will be according to the rules and regulations stated below. The sitters will earn their net
income after Doggity’s commission from the total payment paid by the owner.
The funds or net income a services provider may earn can be deposited into the bank account provided
by the sitter.
6.1 - Rules Of Our Payment Policy:
a. The prices vary from job to job and depend on the particular dog owner.
b. The structure of the prices will be as determined by the sitter
c. There will be a 20% service fee as a commission is taken from the total deposited amount. This
service fee will depend on the total value of the job.
d. After the owners’ funds are deposited Doggity will hold these funds in an escrow account.
e. Doggity’s platform will store funds for the term specified until the job is completed successfully.
f. The funds will be transferred to the sitter’s account after 72 hours of successful job completion.
g. In case of order cancellation, the total amount of the order will be transferred back to the
owner.
h. The sitters can only withdraw the amount from their own account and they can only withdraw
their own net income.
i. In case of any restrictions against any account, the ability to withdraw may be restricted until
the issue gets resolved.

7. USER ACCOUNT, LOG IN, AND PASSWORD
After the account registration, it will be the responsibility of the user to keep the account information
confidential. The user alone will be responsible for any activity that happens under his/her/their account
whether or not they have authorized it. If any user or account holder of our website has a reason to
believe that their account and/or login information has been compromised, they are requested to
contact us immediately.
8. INTELLECTUAL PROPERTY AND AVAILABILITY OF SERVICES
The source code, logos, audio, videos, compositions, words, design, videos, samples, layout, graphics,
photos, images, information, materials, documents, data, databases, and all other information and
intellectual property accessible on or through our website is the property of Doggity and is protected by
intellectual property laws. If you have used a service or otherwise entered into a separate agreement
with us you will also be subject to the terms of that agreement or those terms of service, which shall
prevail in the event of a conflict.
8.1. Grant Of Limited License.
All users are hereby granted a limited license for the purpose of using our services. Users can use the
services of Doggity in accordance with these terms however, they cannot share, sell or lease any form of
information, suggestions or advice offered through Doggity. You affirm, confirm and agree that you will
not exploit any portion of our service and you are not authorized to use any of the services unless you
have acquired prior written permission from us.
9. THIRD-PARTY LINKS
There may be the presence of third-party links through our website whether by us or by other users.
These links may lead you to websites, clients, and platforms outside of the website. The links that you
may choose to view and follow are at your own risk. Doggity takes no liability for any linked sites or their
content which may change without notice. Any link to any other platform or website does not imply that
Doggity endorses or accepts any responsibility for the content, safety, reliability, or quality of the
materials provided by such platform or website.
10. STATUS OF THE SITTERS
By using our services the users (including the owners and sitters) agree and acknowledge that all users
act and provide services independently and none of the users are, for any purpose, employees of
Doggity. Users do not have the authority to enter into agreements or contracts on behalf of our website,
and shall not represent that they possess any such authority. Similarly, we have no authority over the
users’ personal work schedules. Users have the freedom to conduct business with whomever they want.
Therefore, all users of our website admit, affirm, and confirm that our website/platform is only acting as
an independent marketplace and that all users are responsible for their own dealings and business
activities.

There may be testimonials, reviews, and feedback on our website related to our services and the
services provided by the users of our platform. The testimonials, examples, and/or photos used are of
actual users and results they have personally achieved or they are comments from individuals who can
speak to our services and the quality of our work. Each person or individual has approved these
testimonials, examples, and photos for use in materials to speak to our advice, written content,
suggestions, videos, products, and services, but they are not intended to represent or guarantee that
current or future users of our services will achieve the same or similar results. Rather, the stories by the
users represent what is possible with our service, content, suggestions, videos, and efforts. Each of
these unique stories, and any and all results reported in these stories by our users on our website and
through our videos, products, and services, are the culmination of numerous variables, some of which
we cannot control.
12. DISCLAIMER REGARDING RESPONSIBILITY
It would be the responsibility of the users of Doggity’s platform to discern all risks related to their tasks,
jobs, and orders. Users themselves are liable for their own damages, losses, or resulting outcomes. By
using our services all users (including sitters and owners) understand that our platform does not employ
any of the dog sitters, but it is only a platform for the users who are neither employees nor associates of
our website or platform. Therefore, it would be upon the owners to handle every possible outcome of
the job they have done and delivered. All of the sitters have the option to decline the job offer in case
the job deems to be against law or seems risky in any way. Similarly, it would be the responsibility of the
owners to deal with all results and outcomes without blaming or criticizing our platform. By using and
working through our platform, all users hereby acknowledge and agree that any legal claims, lawsuits,
legal actions, complaints, or judicial proceedings resulting from any order, task, or job are expressly
denied by Doggity that may result from any legal issues between the owner and sitter.
13. LIABILITY DISCLAIMER
Liability of any by Doggity, the owner(s), team and staff members, employees, consultants, affiliates,
and its partners for direct, indirect, special, incidental, or consequential damages (including damages for
losses on investments or lost profits or for any claim or demand by any third party, even if we, and our
team and staff members, employees, consultants, affiliates or our partners knew or had reason to know
of the possibility of such damages claim or demand arising under any theory of law in tort, contract,
strict liability) from, or in connection with, the access (or the inability of access) to or use of the
Doggity’s platform is excluded and is hereby expressly disclaimed by our company and related associates
to the fullest extent permitted under applicable law and regulations.
14. WAIVER AND INDEMNIFICATION
By joining and using the website and Doggity, you are agreeing to terminate all liability for losses you
may suffer. You are also agreeing that you fully and completely hold harmless, indemnify and release
Doggity (firm and company) its owner from any and all damages, causes of action, liability, suits,
allegations, sums of money, claims, and demands whatsoever, in law or equity, that you ever had, now
have or will have in the future against Doggity, arising from your participation in or in any way related to
the firm’s services, even if we were aware in advance of the possibility of any such claim. Liability of any
kind by Doggity, its owner, admins(s), team and staff members, partners, and other associates is hereby
expressly disclaimed by Doggity to the fullest extent permitted under applicable law and regulations.

15. ACCEPTABLE USAGE POLICY
By using our services, you agree that you will only use this service for the purposes within these terms of
use and according to law, regulations, and other guidelines which are either expressly or impliedly given.
15.1. General Rules
a. Accessing any of our resources by means other than what we provide is prohibited. You agree
that you will not access our website in any unlawful manner or any other unethical manner
whichever it may be.
b. By accessing our website or and using it the users are responsible for maintaining the
confidentiality of any login, registration, or any information associated with any account they
access and use. Henceforth, users agree they are solely responsible for the activities that occur
under their account.
c. It is prohibited to engage in any activity or business which may disrupt or interfere with our
website’s content, our services, and our business.
d. You agree that you will not duplicate, copy, or counterfeit source code, logos, business models,
products, videos, samples, or services related to Doggity’s website in any way nor will you sell
them on your own.
e. By using our services, you agree that you are responsible for the consequences, losses, or
damages that may directly or indirectly incur due to any unlawful, unethical, or unauthorized
activity as explained above. For which you may be held responsible in the eyes of law.
f. You will report any unethical, illegal, or any other prohibited content to us.
g. When posting written or any other content makes sure that the content does not contain or
install any viruses, worms, malware, Trojan horses, or other harmful or destructive content.
h. You will not upload, host or transmit any viruses, malware, adware, spyware, worms, Trojan
horses, keystroke loggers, spyware, logic bombs, time bombs, or any other harmful programs or
code which could adversely affect the use or operation of the app, website, our hardware or
systems, or the computers, tablets, phones or other devices of any users or other third parties,
or to upload any content or materials containing any such content.
i. You must not in any way or for any purpose breach these Terms or the terms of any of the
documents of these Terms.
a. You will not charge back the amount you already paid.
b. Impersonate any person and use a fake name or gain access to anyone’s account in any way or
a manner that may deem unlawful.
15.2. Breach Of Any Rules or Our Acceptable Use Of Services Policy
If we find that anyone is breaking any rules or in any other case of suspicious behavior, we reserve the
right to withdraw access to your account without notice for any actual or suspected breach of these
terms or any other documentation referred to in them, including, without limitation, where we suspect
that there has been unauthorized access to your account or any unauthorized disclosure of your login
information.
15.3. Factors Beyond Our Control

Any act or situation which is beyond our control is known as a “Force Majeure Event”. In such a
circumstance, we are not liable for any failure to perform or delay in the performance of our obligations
or shipping under our general terms. In any such event, the order or project can be canceled and any
amount retained will be refunded. Any act, event, non-happening, omission, or accident beyond our
control includes (but is not limited to):
a. Strikes, lock-outs, or other industrial action.
b. Civil commotion, riot, invasion, cyber-attack, terrorist attack or threat of terrorist attack, war
(whether declared or not), or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disasters.
d. Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public
or private transport.
e. Interruption or failure of utility service (including the inability to use public or private
telecommunications networks).
f. Failure of any workforce availability due to any reason.
g. The acts, decrees, legislation, regulations, or restrictions of any government.
16. LAW AND JURISDICTION
The Conditions will be governed by and construed in accordance with the law of the United States, and
any disputes relating to the Conditions will be subject to the jurisdiction of the courts of the United
States.
